These Terms of Service (“Terms”) govern your access to and use of the Miracle Wizard website, online store, products, and related services (collectively, the “Services”).

The Services are operated by Miracle Wizard LLC (“Miracle Wizard,” “we,” “us,” or “our”). Our online store is hosted by Shopify, which enables us to offer our products and Services to you.

By visiting our website, placing an order, enrolling in a subscription, creating an account, or otherwise using the Services, you agree to these Terms and the policies referenced in them. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least the age of majority in your state or jurisdiction of residence to make a purchase through the Services. If you allow a minor dependent to use the Services, you are responsible for their use.

You may not use the Services or our products for any unlawful or unauthorized purpose.

2. Products and Product Information

We make reasonable efforts to display and describe our products accurately. However, product colors, packaging, appearance, measurements, ingredients, and other details may vary slightly from photographs or descriptions displayed on the website.

We may modify, discontinue, limit, or replace products at any time without notice. Product availability is not guaranteed.

Miracle Wizard products must be used, handled, placed, and stored according to the directions and warnings provided on the product packaging.

Individual results may vary depending on product placement, environmental conditions, the severity of rodent activity, the condition of the property, and other circumstances outside our control. No product can guarantee that a property will remain completely free of rodents.

Nothing in this section limits our published 30-day satisfaction guarantee.

3. Orders

Your submission of an order is an offer to purchase the products in your cart. We reserve the right to accept, reject, limit, or cancel an order, including orders that appear to involve:

• Incorrect pricing or product information

• Suspected fraud or unauthorized payment activity

• Product availability issues

• Resale or commercial redistribution

• Abuse of promotions, subscriptions, or our refund policy

• Violations of these Terms

An order confirmation does not necessarily mean that an order has been accepted. If we cancel an order after payment has been collected, we will issue a refund for the canceled portion.

Please provide current, complete, and accurate billing, shipping, payment, and contact information. We are not responsible for delays or delivery problems caused by incorrect or incomplete information provided during checkout.

4. Prices and Payment

Prices are shown in U.S. dollars unless otherwise stated. Prices, discounts, promotions, and product availability may change without notice.

Applicable taxes, shipping charges, and other fees will be displayed during checkout before you complete your purchase.

You authorize us and our payment providers to charge the payment method submitted at checkout for your order, including applicable taxes, shipping charges, and recurring subscription charges when you enroll in a subscription.

If a product is listed at an incorrect price because of a typographical, technical, or other error, we may cancel the affected order and issue a refund.

5. Promotions, Bundles, and Discounts

Promotions, discount codes, subscription savings, bundles, and other offers may be subject to separate conditions disclosed with the offer.

Unless expressly stated otherwise:

• Discounts cannot be combined.

• Promotions have no cash value.

• Promotional offers may be changed or discontinued at any time.

• Discounts cannot be applied retroactively to completed orders.

• Bundle and subscription orders remain covered by our published 30-day satisfaction guarantee.

6. Subscriptions and Automatic Renewal

When you purchase a subscription, you authorize Miracle Wizard and its payment providers to charge your selected payment method automatically at the billing and delivery frequency shown at checkout.

Your subscription will continue and renew automatically until you cancel it. The price, frequency, estimated renewal date, and any applicable discount will be disclosed before you complete your subscription purchase.

You may manage or cancel your subscription through the customer subscription portal or by contacting support@miraclewizard.com.

Cancellation must be completed before the next subscription order is processed to prevent the next recurring charge. Canceling a subscription does not automatically cancel or refund an order that has already been processed, fulfilled, or shipped.

If your payment method is declined, we or our subscription provider may attempt to process the payment again and may contact you to update your payment information.

We may modify subscription pricing or terms by providing any notice required by applicable law. Changes will not take effect until permitted by law. You may cancel your subscription if you do not agree with a change.

7. Shipping and Delivery

Shipping dates and delivery estimates are provided as estimates and are not guaranteed. Delivery may be affected by carrier delays, weather, holidays, address errors, supply interruptions, and other circumstances outside our reasonable control.

Risk of loss and title to purchased products pass as provided by applicable law and the terms of the shipping carrier.

8. Returns, Refunds, and Replacements

Eligible purchases are covered by our published 30-day satisfaction guarantee.

Return, refund, replacement, and damaged-order requests are governed by our Return & Refund Policy. That policy is incorporated into these Terms by reference.

Canceling a subscription prevents future renewals but does not automatically create a refund for an order that has already been processed or shipped.

9. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Please notify us promptly if you believe your account or payment information has been accessed or used without authorization.

We may suspend or terminate an account if we reasonably believe it is being used fraudulently, unlawfully, or in violation of these Terms.

10. Reviews, Feedback, and Other Submissions

If you submit a review, photograph, testimonial, suggestion, comment, or other content to us, you represent that:

• You have the right to submit the content.

• The content reflects your honest experience or opinion.

• The content does not violate another person’s rights.

• The content is not unlawful, fraudulent, misleading, threatening, defamatory, obscene, or harmful.

• The content does not contain malicious code or unauthorized advertising.

You retain ownership of your content. However, by submitting it, you grant Miracle Wizard a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, publish, display, distribute, and create derivative works from that content in connection with our business, marketing, and Services, subject to applicable law.

We may remove or decline to publish content that violates these Terms. We are not obligated to keep submissions confidential, compensate you for them, or respond to them unless we separately agree in writing.

We will not materially alter the meaning of a customer review or present a review in a misleading manner.

11. Intellectual Property

The Services and their contents—including the Miracle Wizard name, logos, product names, packaging, text, photographs, graphics, videos, designs, and website elements—are owned by or licensed to Miracle Wizard and are protected by applicable intellectual-property laws.

You may access and use the Services only for personal, noncommercial shopping purposes.

Without our prior written permission, you may not copy, reproduce, modify, distribute, sell, license, publicly display, scrape, reverse engineer, or commercially exploit any portion of the Services or our intellectual property.

12. Prohibited Uses

You may not use the Services:

• For an unlawful, fraudulent, or deceptive purpose

• To violate the rights of Miracle Wizard or another person

• To submit false or misleading information

• To transmit viruses, malware, or harmful code

• To interfere with the security or operation of the Services

• To collect information about other users without authorization

• To impersonate another person

• To place fraudulent orders or abuse discounts, refunds, or subscriptions

• To copy, scrape, or commercially exploit website content without permission

• To circumvent security or access controls

We may suspend or terminate access for violations of this section.

13. Third-Party Services and Links

The Services may include tools, payment services, applications, content, or links provided by third parties, including Shopify and other service providers.

We do not control and are not responsible for third-party websites, services, products, privacy practices, or content. Your use of a third-party service may be governed by that provider’s separate terms and policies.

Depending on your location, additional choices concerning targeted advertising or data sharing may be available through our Your Privacy Choices page.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and website content are provided on an “as available” basis.

Except for express promises stated in these Terms, our product packaging, or our published policies, we disclaim warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the website will always be uninterrupted, secure, or error-free.

Some jurisdictions do not permit the exclusion of certain warranties, so portions of this section may not apply to you. Nothing in these Terms limits rights that cannot legally be waived.

16. Limitation of Liability

To the fullest extent permitted by law, Miracle Wizard LLC and its owners, employees, contractors, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from the Services, products, or these Terms.

Where permitted by law, our total liability for a claim relating to a product or order will not exceed the amount you paid for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including any rights provided by applicable consumer-protection law.

17. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Miracle Wizard LLC and its owners, employees, contractors, affiliates, and service providers from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the Services, your violation of these Terms, or your violation of another person’s rights.

This section does not require you to indemnify us for our own unlawful, reckless, or intentionally wrongful conduct.

18. Termination

We may suspend or terminate your access to the Services if you materially violate these Terms, use the Services unlawfully, or engage in fraudulent or abusive activity.

Obligations and liabilities incurred before termination will survive. Provisions that reasonably should survive termination—including intellectual-property, disclaimer, liability, indemnification, and governing-law provisions—will remain effective.

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any court proceeding arising from these Terms will be brought in a court with appropriate jurisdiction in San Diego County, California, unless applicable consumer law permits or requires a different location.

These Terms do not contain a mandatory arbitration agreement or class-action waiver.

20. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary. The remaining provisions will remain in effect.

21. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

22. Entire Agreement

These Terms and the policies incorporated by reference constitute the entire agreement between you and Miracle Wizard concerning your use of the Services and supersede prior understandings concerning that subject.

Any ambiguity in these Terms will not be interpreted against a party solely because that party drafted them.

23. Changes to These Terms

We may update these Terms periodically to reflect changes to our Services, business practices, or legal obligations.

The updated Terms will be posted on this page with a revised “Last updated” date. Changes will apply prospectively unless applicable law permits or requires otherwise.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those changes, except where additional notice or consent is required by law.
